Wedding Photography Contract
ENTIRE AGREEMENT: This agreement contains the entire understanding between Clive Hawes of Profound Image Photography hereafter “Profound Image” and the Bride and Groom.
CONFIRMATION: A signed “Wedding Photography Contract” and payment of the booking fee are necessary to confirm the stated wedding services from Profound Image.
PRE-WEDDING CONSULTATION: This will normally take place at the time of booking or at a pre-booking engagement shoot. The Bride and Groom will outline broadly what is required. Profound Image will advise on planning, logistics and timings where needed. The Bride and Groom are welcome to contact us for an additional chat closer to the time of the wedding (about 2 weeks before) to finalise any remaining details. We will contact you by phone approximately one week before the wedding to ensure that there have been no last-minute changes and to run through final details.
CO-OPERATION: Profound Image recommend that we are provided with a helper (usually the best man or an usher) who will point out and assist in organising key individuals to be photographed. The bride and groom agree to give sufficient warning of key events at the wedding to give us time to prepare e.g. bouquet throwing, cutting the cake, speeches etc. Please note that not all of your guests at the wedding will like having their photo taken. In such cases Profound Image will use their discretion and best endeavours although no guarantee can be made that all guests will be captured.
EXCLUSIVITY: Profound Image will undertake no other bookings on the date of the wedding. It is understood that Profound Image are retained as the official exclusive Photographer and no other person is permitted to shoot images for sale or as gifts unless agreed in writing before the day. This includes guests (except for their own personal non-commercial use). Breach of this condition shall be deemed cancellation of the contract by the clients.
RESPONSIBILITIES: I understand that wedding guests will want to take photos. It is the responsibility of the Bride and Groom to prevent family and friends from interfering with the Photographer's duties. Profound Image is not responsible for compromised coverage due to causes beyond their control such as other people's camera or flash, the lateness of key people, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. Coverage may be cancelled at the discretion of the photographer if the photographer feels threatened or has reason to believe that photographic equipment may be damaged.
CREATIVE LICENCE: Profound Image shall be granted creative and artistic license in relation to the choice of locations, styles, number of images and poses used and Profound Image’s judgement will be deemed correct. Profound Image will provide coverage for the dates, locations and continuous hours specified in this Agreement. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organisational purposes only. Images determined by the photographer to be substandard or duplicated may be edited out. The Photographer will use his professional judgement and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client. Photographic style is open to interpretation, and the Client should be fully aware of what they are asking for to avoid misunderstandings in their wedding coverage. COPYRIGHT: English Copyright Law states that the copyright of photographs remains with the photographer. Profound Image grant the Bride and Groom permission to make copies and prints of the images under the following conditions. The images taken by the Photographers are for personal use by the bride and groom and their friends and relatives. Selling, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographers.
MODEL RELEASE: The Bride and Groom grant Profound Image and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the bride and groom for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Bride and Groom hereby release Profound Image and its legal representatives, heirs and assigns from all liability and claims in connection with the images.
LIMIT OF LIABILITY: In extenuating circumstances e.g. death, personal injury or sickness to the photographer (this list is not exhaustive), Profound Image reserves the right to seek to find a replacement photographer to undertake the contract. If a replacement photographer cannot be found then liability is limited to a refund of any payments received. Profound Image cannot be held responsible for breach of this contract due to circumstances beyond their control. These circumstances include but are not limited to: lack of access to the venue, church / reception venue becoming unavailable, weather conditions preventing travelling etc. There is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
DEPOSIT & PAYMENTS: The Payment schedule is as follows:
a) A 25% booking fee is payable in order to secure our photographic services on your wedding date. This is payable upon signing this contract. This contract will only come into effect when the booking fee has been received. Profound Image reserves the right to annul the agreement if the fee is not received within one week of signing this contract. The balance may be paid in full upon booking if preferred. In the event of cancellation for whatever reason by the client, the booking fee is non-refundable.
b) Any remaining balance for agreed services must be paid no later than 2 weeks prior to the Wedding Date. Please note that failure to make payments by the due dates may result in cancellation of this wedding agreement. c) Payments may be made by bank transfer or a cheque payable to “Profound Image Photography”. Bank details are Sort Code: 05-06-33, account number 41050638. Please quote your surname and wedding date as the reference. FEE VARIATIONS: Prices quoted for Wedding Services at the time of booking will be held up to the Wedding date. Additional album and print orders will be subject to the Studio pricing structure in force at the time of ordering
CANCELLATION / TERMINATION: The Client may terminate this Contract at any time by giving written notice to Profound Image. Cancellations of any wedding within 10 weeks of the wedding date will result in the client being liable to pay 50% of the package fee booked. Cancellation of any wedding within 4 weeks of the wedding date will result in the client being liable to pay the full amount of the package fee booked. The said sum is payable as compensation of lost bookings and other losses Profound Image may suffer. This contract will also terminate on completion of the supply of the album or prints or images on disk by Profound Image to the Client. In the case of pre- purchased prints and albums, the contract will terminate 356 days after the Wedding Date if the Client fails to instruct Profound Image to place a print order, disk order or album design into production. In either case no monies previously paid to the Profound Image will be refundable. Products and services ordered after this date will be subject to a new agreement and pricing.
HOUSE RULES: Profound Image will sometimes be limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. Every effort will be made to capture photographs of your wedding service, but this at the discretion of the authorised individual performing the ceremony. For example, some ministers insist that flash photography is not allowed, whilst others will insist that the photographer shoots from a specific location. In such circumstances, the Bride and Groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the Bride and Groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned. Therefore, photographs of the service cannot be guaranteed but will be captured if circumstances allow.
POST PRODUCTION AND DELIVERY: All image and album sizes are nominal. Profound Image will provide a pleasing colour balance but cannot guarantee exact colour matching. Images will be provided edited, unwatermarked and in digital format within 3 weeks of the wedding date. Where an album is included as part of the package, this will be delivered within 6 weeks of the wedding date or a later date by mutual agreement. ARCHIVING: Profound Image will endeavour to retain the images on file for a minimum of one year following the Wedding Date, but no guarantees are given in respect of image retrieval or reproduction from the original files. We have understood the contents of this contract and agree to the terms therein.
